⚠️ Important Notice

Welcome to sign this “Mongoyia Platform Terms of Service” (hereinafter referred to as the “Agreement”) with the operators of the Mongoyia platform (as defined below) and to use Mongoyia’s services.

This Agreement is a revised version of the previous “Mongoyia Service Agreement”. From the date of its publication, any reference to the “Mongoyia Service Agreement” across the platform shall mean this Agreement. The keywords listed before each clause are for your convenience only and do not affect or limit the interpretation of the clause.

We strongly recommend that you read all clauses carefully, especially those involving exemption or limitation of liability, governing law, and dispute resolution, which are marked in bold and underlined. If you have any questions, please contact Mongoyia customer support.

🔍 Before You Agree

You should carefully read this Agreement before clicking “I Agree” during registration. By completing the registration process — including filling in information, reading, and agreeing to this Agreement — you confirm that you have fully read, understood, and accepted all terms herein, and have entered into a binding agreement with Mongoyia. If you do not agree with any part of this Agreement, please stop the registration process immediately.

1. Definitions

Mongoyia Platform: Includes the website mongoyia.com and its mobile applications.
Mongoyia Platform Services: Services provided by Mongoyia via the internet, including but not limited to the website, app, and future technological forms.
Mongoyia Platform Rules: All rules, interpretations, announcements, policies, and guidelines published on the platform’s rule center, forums, help center, or groups, whether currently available or released in the future.
Mongoyia Website Rules: Specific rules listed on the Mongoyia rule page. See here (link to rules page).
Affiliated Companies: HONG KONG CHUANGKE TECHNOLOGY LIMITED.

2. Scope of Agreement

2.1 Contracting Parties

This Agreement is a legally binding contract between you (the user) and the Mongoyia platform operator(s).
The operator is the legal entity operating the Mongoyia platform. You may view the operator’s business license and registration information at the bottom of the Mongoyia homepage.
The operator may change due to business adjustments. Any such change will not affect your rights under this Agreement.
If new services are introduced, your use of those services constitutes acceptance of the new operator(s) under this Agreement.
In case of disputes, you may determine the responsible party based on the specific service used and actions taken.

2.2 Supplementary Agreements

Due to the rapid development of the internet, this Agreement may not cover every scenario. Therefore, the following documents are integral supplements to this Agreement and have equal legal effect:

Your continued use of the services constitutes acceptance of these supplementary agreements.

3. Account Registration and Use

3.1 User Eligibility

You must:

Have the legal capacity to enter into contracts under applicable laws.
Not be subject to international trade sanctions, economic restrictions, or prohibited by any government authority.
Not provide funds, goods, or services to sanctioned entities.

Failure to meet these conditions may result in account suspension and legal liability.

3.2 Account Information

📌 Account Creation

One user = one account.
Creating an account requires completing registration steps and accepting this Agreement.
Multiple accounts or suspicious registration behavior may lead to:
- Account freezing or closure
- Order cancellation
- Service denial
- Liability for damages

📌 Account Usage

You may log in using your chosen username, email, phone number, and password.
Accounts created before June 18, 2024, or using previously registered credentials, may have limited functionality.
Your account is personal and must not be shared or transferred without Mongoyia’s consent.
Mongoyia may suspend services if account usage threatens security.

📌 Account Transfer

Account transfer is only permitted under:
- Legal requirement
- Court order
- Mongoyia’s written approval
- Compliance with platform rules
Unauthorized transfers will result in liability.

📌 Real-Name Verification

Mongoyia may require real-name authentication for security and compliance.

📌 Inactive Account Recovery

Mongoyia may reclaim your account if:

Not linked to a verified real-name account;
No login activity for 6 consecutive months;
No active services or subscriptions.

After recovery, the account cannot be used to access any Mongoyia service.

3.3 Registration Information Management

3.3.1 Accuracy and Legality

Provide accurate, complete, and up-to-date personal information (name, email, phone, address).
Keep information current to ensure communication.
Username must comply with laws and platform rules. Violations may lead to username removal.

3.3.2 Updates and Compliance

You must promptly update your information.
Mongoyia may verify your data as required by law.
Failure to provide valid information may result in:
- Service suspension
- Re-authentication requests
- Termination of service
Mongoyia is not liable for consequences arising from outdated or false information.

3.4 Account Security

🔐 Security Responsibility

You are solely responsible for protecting your account and password.
Mongoyia will never ask for your password.
Always log out after each session.

❗ Note: Loss due to phishing, hacking, or sharing your password is your responsibility. Seek legal remedies against third parties.

🧑‍⚖️ Responsibility for Account Actions

You are responsible for all activities under your account, including:
- Signing agreements
- Posting content
- Purchasing goods/services
- Sharing information
Exceptions apply only if Mongoyia is at fault.

🛡️ Unauthorized Access

If you suspect unauthorized access, notify Mongoyia immediately.
Mongoyia will act promptly but cannot guarantee prevention of harm.
No liability unless Mongoyia is legally at fault.

4. Services and Usage Guidelines

4.1 Browsing & Saving Items

You may:

Browse, search, filter, save, and follow products, stores, or brands.
Add items to cart or wish list.

4.2 Purchasing & Reviews

🛒 Purchasing

When purchasing:

Confirm product name, price, quantity, size, specifications, and delivery details.
Verify recipient information. If the recipient is not you, you bear all legal consequences.
Orders are generated automatically upon confirmation.
You and the seller are the contracting parties.
Mongoyia’s system, rules, and transaction flows form part of the contract and are legally binding.

⚖️ Mongoyia may close an order if:

The transaction violates platform rules

There is severe imbalance in rights/obligations

There is malicious behavior (e.g., bulk buying to disrupt order)

Closing an order = automatic contract termination.
Refunds will be issued via original payment method.

You must not:

Engage in malicious purchases
Abuse consumer rights
Disrupt normal trading order

✍️ Product Reviews

You may leave public reviews after a transaction.

Review Requirements:

Must be legal, objective, truthful, and related to the product/service.
Must not contain:
- Obscenity, pornography, violence
- Defamation, threats, spam
- False advertising or fraud
- Hate speech or discrimination
Anonymous reviews are allowed if you wish to protect identity.

Mongoyia may remove or block inappropriate reviews per platform rules.

4.3 Dispute Resolution

Available Channels:

Direct negotiation with the other party
Use of Mongoyia’s dispute mediation service
Mediation by consumer associations
Complaint to government agencies
Arbitration (if agreement exists)
Filing a lawsuit

🤝 Platform Mediation

If you use Mongoyia’s mediation service, you agree to abide by the decision made by customer service or crowd jurors (“mediators”).
You may withdraw from mediation and pursue other legal options.
However, you must comply with the mediation decision until a final legal ruling is made.

Note: Mediators are ordinary users and not professionals. They are not liable unless grossly negligent.

4.4 Information Sharing

You may use features like Q&A, forums, live streams, comments, and group chats to share experiences.

Allowed formats: text, images, video, audio, emojis, symbols.

You must ensure all content complies with laws and this Agreement.

4.5 Trade Restrictions

You agree to comply with all export controls, trade sanctions, and economic restrictions.

Do not:

Resell goods/services in violation of laws
Transfer technology without proper authorization

Violation may result in:

Order closure
Account penalties
No liability assumed by Mongoyia

4.6 Fees

Most services are currently free.
If fees are introduced in the future, Mongoyia will:
- Notify you in advance via official channels (per Section 8)
- Allow sufficient time to opt out
- Ensure your right to choose

4.7 Limitation of Liability

Mongoyia is not liable for failures or delays caused by:

Force Majeure: Natural disasters, strikes, war, government actions
Third-Party Issues: Power outages, network failures
System Maintenance: Routine or emergency maintenance, security updates (provided Mongoyia acts in good faith)

📢 Note on Content

Information on Mongoyia is user-generated.
Mongoyia does not pre-screen every product or service.
You are advised to exercise caution when evaluating quality, safety, legality, or accuracy.

🧑‍⚖️ Mediation Disclaimer

Mediators make decisions based on general understanding.
They are not liable unless acting with gross negligence or intent.

5. User Data Protection and Authorization

5.1 Personal Information Protection

Mongoyia values your privacy.

By using the service, you agree that your personal data (information that identifies you) will be collected, stored, used, disclosed, and protected in accordance with the Mongoyia Privacy Policy.

If a sub-service lacks its own privacy policy but uses your Mongoyia account, the main Mongoyia Privacy Policy applies.

We recommend reading the full Privacy Policy to understand how your data is handled.

5.2 Non-Personal Information & Authorization

📢 Content You Post

You warrant that:

You own or have rights to the content you post.
Your content complies with laws, standards, and this Agreement.
You will promptly remove any violating content.

Mongoyia may delete or block illegal content.

❌ Prohibited Content

You must not post any of the following:

Content opposing constitutional principles
Threats to national security, leaks of state secrets
Incitement of terrorism, extremism
Ethnic, regional, or social discrimination
Religious extremism or cult promotion
Obscenity, pornography, gambling, violence
Defamation, invasion of privacy or intellectual property
Spreading rumors or fake news
Harassment, threats, cyberbullying
Content harmful to minors
Unauthorized surveillance (e.g., hidden cameras)
Spam or excessive marketing
Use of non-standard languages (unless permitted)
Nonsensical or evasive content (e.g., symbol spam)
Clickbait or misleading headlines
Gossip, scandals, or celebrity shaming
Inappropriate commentary on disasters
Vulgar,庸俗, or materialistic content
Dangerous or self-harming acts (e.g., suicide, stunts)
Impersonation of others
Malware, viruses, crawlers, or data theft tools
Any other content violating laws or social ethics

🔑 License Grant

For non-personal content (text, images, videos, etc.) you upload or create:

You retain all intellectual property rights.
You grant Mongoyia and its affiliates a worldwide, royalty-free, perpetual license to:
- Store, use, copy, edit, translate, distribute
- Display, publish, create derivative works
- Use in any media or technology (existing or future)
This license includes the right to sublicense and enforce rights (e.g., sue infringers).

You also authorize Mongoyia to:

Share your data across affiliated services
Receive data from other Mongoyia services

5.3 Reporting Violations

If you find illegal or harmful content, report it via:

Mongoyia will respond in accordance with law.

6. User Violations & Penalties

6.1 Violation Determination

You are considered in breach if:

You violate any law or regulation
You violate this Agreement or its supplements
Your behavior is flagged by system analysis (e.g., abnormal data patterns)
You fail to explain suspicious activity

6.2 Penalties

🔲 Content Removal

Illegal or violating content may be deleted or blocked immediately.

🔲 Account Restrictions

Account deduction points
Partial or full service suspension
Deduction of penalty fees

For serious violations, Mongoyia may:

Suspend or terminate your account

🔒 Financial Controls

In cases of fraud, counterfeiting, account theft, or security risks, Mongoyia may:

Freeze funds
Block withdrawals
Stop payments

📢 Public Disclosure

Mongoyia may publicly display:

Penalty records
Legal rulings against you

6.3 Compensation

You agree to compensate Mongoyia and its affiliates for:

Direct and indirect losses (e.g., legal fees, settlements, reputational damage)
Payments made to third parties due to your actions

Mongoyia may:

Deduct compensation from your account balance or deposit
Use its own funds to cover costs, which you must repay
Offset debts across other agreements with you
Pursue further legal action if needed

6.4 Special Clauses

💰 Anti-Bribery

Offering gifts, cash, travel, or favors to Mongoyia employees or consultants that exceed normal business norms constitutes commercial bribery.

Consequences:

Immediate termination of cooperation
Penalty fees based on actual losses and reputational damage

🔗 Cross-Agreement Enforcement

If you seriously breach this Agreement, Mongoyia may:

Suspend or terminate other agreements with you
Notify you via Section 8 methods
Apply cross-platform penalties as allowed by other contracts

7. Agreement Modifications

Mongoyia may update this Agreement to:

Comply with legal changes
Protect user rights
Maintain platform order

Changes will be notified via:

Website announcement
Email/SMS
In-app messages (Section 8)

You may:

Review changes before they take effect
Provide feedback (may be considered)
Opt out by stopping service use before the effective date

If you continue using the service after changes take effect, you are deemed to have accepted them.

8. Notices

8.1 Valid Contact Methods

You must provide and keep updated:

Email address
Phone number
Mailing address
Login account (for system messages)

These are your official contact points.

You may opt out of promotional messages via the unsubscribe link.

8.2 Notice Delivery

Mongoyia may send notices via:

Website announcements
SMS
Email
In-app messages (system, inbox)

Electronic notices are deemed delivered upon sending.
Physical mail is deemed delivered 5 days after posting.

For legal disputes, you agree that courts may serve legal documents via:

SMS
Email
Mail

You are responsible for keeping your contact info accurate. Failure to receive notices due to outdated info is at your own risk.

9. Termination of Agreement

9.1 Termination Scenarios

✅ By You:

You may terminate by:

Using the self-service account deletion tool (if eligible)
Stopping use before a new agreement takes effect
Explicitly stating your intent to discontinue service

❌ By Mongoyia:

Mongoyia may terminate if you:

Breach this Agreement
Steal accounts, sell fakes, scam others
Repeatedly violate rules with serious impact
Have your account reclaimed (per Section 3.2)
Engage in fraud, IP infringement, or illegal acts
Other severe violations

9.2 Post-Termination

🔐 Data Disclosure

Mongoyia has no obligation to disclose your account data after termination, unless required by law.

📂 Mongoyia’s Rights

May retain your data per Section 5
May still pursue liability for past violations

🛒 Ongoing Transactions

For active orders, Mongoyia may:
- Notify the counterparty
- Close the order, or
- Allow fulfillment if the other party requests
You remain responsible for fulfilling valid orders and bearing related costs.

10. Governing Law & Dispute Resolution

🏛️ Governing Law

This Agreement is governed by the laws of Mainland China.
Where laws are silent, commercial and industry practices apply.

⚖️ Jurisdiction

Disputes arising from or related to this Agreement:

Shall first be resolved through negotiation.
If unresolved, either party may file a lawsuit in the court of the defendant’s jurisdiction.

🔁 Severability

If any clause is found invalid, it shall be severed. The rest of the Agreement remains fully effective.
